The myth goes like this: whenever a car accident happens, a lawyer’s “super sense” tingles, they sprint to the scene with business cards in hand, and pretend to care just long enough to snag a client.

The stereotype of the ambulance-chasing lawyer has persisted for decades, but professional ethics rules make this behavior impossible. Under the rules of professional responsibility, attorneys cannot directly contact potential clients unless they are family members or have a prior relationship with them.

So no,  lawyers aren’t racing to crash scenes or handing out business cards on the roadside. Doing so could result in disbarment losing their license to practice law entirely.

At most, lawyers can send advertising materials by mail, clearly labeled as such. The truth is,  lawyers work within strict ethical limits to protect clients and uphold the integrity of the legal profession.

Despite their reputation, lawyers play a vital role when someone is hurt in an accident. After a collision or injury, determining which insurance company is responsible and ensuring they pay fair compensation can be complicated.

Well, I hate to disappoint, but the myth of the lawyer far exceeds reality…especially the part about them being able to run.  In fact, the rules of professional responsibility dictate that lawyers cannot make direct contact with potential clients unless they are family or the lawyer has a close personal relationship with the person.  Therefore, in our example, soliciting a client on the scene of an accident could be grounds for disbarment (losing your law license).

The most a lawyer can do is send you a letter in the mail that very obviously says “Advertising Material” on the envelope and letter.

Despite this bad reputation,  lawyers can be a real asset during a personal injury.  Finding the responsible insurance company in an accident can be difficult.  And then once you determine who is liable for your injuries, it can be even more difficult to get the insurance company to pay for your medical bills.  This is what a lawyer exists for…even if he might wear cross-trainers to the office.
